Issue

  • 2015. Homeowner & builder signed a contract to build a new luxury home.
  • 2016. After moving in the owner found that the house leaked almost everywhere.
  • 2016 – 2021. Builder attempted to repair over several years, but to no avail.
  • 2021. Homeowner & builder fell out.

Our case

  • Homeowner filed a complaint with the QBCC, but the filing was out of time and so the QBCC couldn’t assist.
  • We filed an application with QCAT.
  • Also, we commenced negotiations with the builder.
  • A long and determined negotiation entailed.

Result

  • Builder agreed to properly rectify the works under a deed of settlement 👍

Note: QBCC are governed by strict timelines, so out of date is usually out of luck!
